1. Am I defense exporter?

The defense export control law, effected since 31 December 2007 defines the regulated realms and domains of equipment, knowledge and services. The law applies to Israeli citizen, Israeli resident and/or Israeli corporation that is involved in defense marketing and export. Our expertise allows you to get the rapid answer if you are obligated to the export license and what kind of the license you should submit.

2. What is Wassenaar Arrangement and why should I know it?

The Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods and Technologies is a multilateral export control regime (MECR) with 42 participating states including many former Comecon (Warsaw Pact) countries established in 1996. The interesting fact - Israel is not a member of Wassenaar Arrangement. However, Israel implements controls in line with Wassenaar Arrangement members and requires authorization for exports of all items listed on Wassenaar control list.
The outline of the arrangement is set out in a document entitled "Guidelines & Procedures, including the Initial Elements". The list of restricted technologies is broken into two parts, the "List of Dual-Use Goods and Technologies" (also known as the Basic List) and the "Munitions List". The Basic List is composed of ten categories based on increasing levels of sophistication from Materials and Equipment up to Aerospace and Propulsion.

3. What is MTCR and what is that good for?

The Missile Technology Control Regime (MTCR) is a multilateral export control regime. It is an informal political understanding among 35 member states that seek to limit the proliferation of missiles and missile technology. The regime was formed in 1987 by the G-7 industrialized countries.

The MTCR seeks to limit the risks of proliferation of weapons of mass destruction by controlling exports of goods and technologies that could make a contribution to delivery systems for such weapons. In this context, the MTCR places particular focus on rockets and unmanned aerial vehicles capable of delivering a payload of at least 500 kilograms (1,100 lb) to a range of at least 300 kilometres (190 mi) and on equipment, software, and technology for such systems.

4. What are the legal charges I am exposed to?

Generally, the violation of the Defense export laws or a condition of the license given by DECA - the authorities may impose a fine or financial sanctions on the company.
Additionally, the Defense Export Control law (since 2007) - paragraph 32 - defines that the violation of meeting the DECA requirements may cause the imprisoning for 3 years or enlarged fine - up to 6.5 miilion NIS (around 1.8 million dollars in 2023). In some cases - under severe circumsatnces - the imprisoning term can be increased to 5 years and the fine to 11 million NIS (around 3 million USD nowadays).

5. Do I need to obtian the DECA approval / export license if I am sending my equipment only for expo like Eurosatory or AUSA?

Generally, the answer is YES. The vast expos worldiwde there Israeli industires stand as the most prominent expositors are great opporunities to showcase your euqipment and your technology. However, every defense or dual use equipment that is being exported from Israel - even on temporary basis - needs to het the apprpriate license.
